style=\"color: #971b1e;\">D\u00e9cret n\u00b02023-275 du 17 avril 2023 sur la mise en \u0153uvre de la pr\u00e9somption de d\u00e9mission en cas d&rsquo;abandon de poste volontaire du salari\u00e9<\/span> (publi\u00e9 au JO du 18 avril).<\/h6><h6>\u00a0 \u00a0 \u00a0Ce texte d\u00e9taille la proc\u00e9dure devant \u00eatre respect\u00e9e par l\u2019employeur qui, constatant que son salari\u00e9 a abandonn\u00e9 son poste, entend faire valoir la <span style=\"color: #971b1e;\">pr\u00e9somption de d\u00e9mission<\/span> instaur\u00e9e par la <span style=\"color: #971b1e;\">Loi n\u00b0 2022-1598 du 21 d\u00e9cembre 2022 portant mesures d&rsquo;urgence relatives au fonctionnement du march\u00e9 du travail<\/span>.<\/h6><h6>\u00a0 \u00a0 \u00a0D\u00e9sormais, le salari\u00e9 qui a volontairement abandonn\u00e9 son poste et ne reprend pas le travail alors qu&rsquo;il a \u00e9t\u00e9 mis en demeure par son employeur de justifier son absence et de reprendre son poste, par LR\/AR ou par lettre remise en main propre contre d\u00e9charge, dans un d\u00e9lai au moins \u00e9gal \u00e0 15 jours, est pr\u00e9sum\u00e9 avoir d\u00e9missionn\u00e9 \u00e0 l\u2019expiration de ce d\u00e9lai (<span style=\"color: #971b1e;\">articles L.1237-1-1 et R.1237-13 du Code du Travail<\/span>).<\/h6><h6>\u00a0 \u00a0 \u00a0Le texte pr\u00e9cise que ce d\u00e9lai commence \u00e0 courir \u00e0 compter de la date de pr\u00e9sentation de la mise en demeure.<\/h6><h6>\u00a0 \u00a0 \u00a0Dans le cas o\u00f9 le salari\u00e9 entend se pr\u00e9valoir aupr\u00e8s de l\u2019employeur d\u2019un <span style=\"color: #971b1e;\">motif l\u00e9gitime<\/span> de nature \u00e0 faire obstacle \u00e0 une pr\u00e9somption de d\u00e9mission, tel que, notamment :<\/h6><h6>&#8211; des raisons m\u00e9dicales ;<\/h6><h6>&#8211; l\u2019exercice du droit de retrait ;<\/h6><h6>&#8211; l\u2019exercice du droit de gr\u00e8ve ;<\/h6><h6>&#8211; son refus d\u2019ex\u00e9cuter une instruction contraire \u00e0 une r\u00e9glementation ;<\/h6><h6>&#8211; ou la modification du contrat de travail \u00e0 l\u2019initiative de l\u2019employeur,<\/h6><h6>il doit indiquer le motif qu\u2019il invoque dans la r\u00e9ponse \u00e0 la mise en demeure.<\/h6><h6>\u00a0 \u00a0 \u00a0Pour toutes contestations relatives \u00e0 la rupture du contrat de travail sur le fondement de cette pr\u00e9somption, il appartiendra au salari\u00e9 de saisir le Conseil de prud\u2019hommes territorialement comp\u00e9tent.<\/h6><h6>\u00a0 \u00a0 \u00a0Telle est la port\u00e9e des dispositions entr\u00e9es en vigueur ce
